It also explains your rights as a Data Principal under the Digital Personal Data Protection Act, 2023 ("DPDPA"), and our commitment to protecting your Personal Data. We use Your Personal data to provide and improve the Service. By using the Service, You agree to the collection and use of information in accordance with this Privacy Policy.

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used. It refers to Data Processor under the DPDPA.
  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
  • Website refers to the official website of Apcotex Industries Limited available at https://apcotex.com, including all webpages, product pages, career pages, contact forms and other online services made available through the website. You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

What Data do we collect from you?

For certain processing, we may also process the Personal Data for legitimate uses as provided under the Digital Personal Data Protection Act, 2023.

  • Processing of Personal Data when consent is provided for the performance of State Function   
  • Processing of Personal Data for the purpose of performance of State Function in the interest of sovereignty and integrity of India  
  • Processing of Personal Data when there is Regulatory obligation to disclose the information

Children's Privacy 

Our service does not address anyone under the age of 18. We do not knowingly collect personally identifiable information from anyone under the age of18. In accordance with Section 9 of the DPDPA 2023, the Company strictly prohibits the processing of any personal data of children that is likely to cause a detrimental effect on the well-being of a child. Furthermore, we do not engage in tracking, behavioural monitoring, or targeted advertising directed toward individuals under the age of 18. 

Processing of Personal Data of a Person with Disability  

Apcotex ensures that the verifiable consent of the lawful guardian is obtained for the processing of personal data of a person with disability. If you are a lawful guardian of a person with disability, you can contact us for any query related Personal Data of the Person with disability.  

Transfer of Your Personal Data

Your information, including Personal Data, is processed at the Company's operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to and maintained on — computers located outside of Your state, province, country or other governmental jurisdiction where the data protection laws may differ from those in your jurisdiction.

You have the right to delete or request that We assist in deleting the Personal Data that We have collected about You.

How long do we keep your data?

For how long Apcotex will hold your Personal Data will vary and will be determined by the following criteria:

  • Apcotex is required to retain the Personal Data for as long as is necessary to satisfy or meet the purpose for which it was obtained or any other legal purpose. Legal obligations: Laws or Regulations may set a minimum period for which Apcotex must retain your Personal Data.
  • Retention schedules are arrived based on the above mentioned criteria and hence disposal of data will follow defined retention schedules.

We maintain reasonable and appropriate security measures to protect Client Data from loss, misuse, and unauthorized access, disclosure, alteration, and destruction.

Data Principals hold specific legal rights under the DPDPA framework: 

Data Principals have certain rights with respect to their personal data. The rights given with respect to your personal data include: 

1. The Right of Access: You have the right to access personal data and supplementary 

information. You can ask us for a copy of your personal information, along with a summary 

of personal data being processed and descriptions of all Data Processors involved. 

2. The Right to Correction & Erasure: You can ask us to change, update, complete, or fix your data in certain cases, particularly if it’s inaccurate, or ask us to erase/delete your 

personal data once the specific purpose for collection is fulfilled, unless legal obligations 

require retention. 

3. The Right to Grievance Redressal: You have the right to register grievances regarding 

any act or omission of the Data Fiduciary. In accordance with the DPDPA framework, you 

must exhaust our internal grievance redressal mechanisms before escalating a complaint to the Data Protection Board of India (DPBI). 

4. The Right to Nomination: The Digital Personal Data Protection Act, 2023, provides data 

principals with a right to nominate a person on their behalf to exercise their rights and to 

ensure the safeguarding of personal data in the event of the data principal’s death or

Processing of Personal Data on the basis of Consent  

When we process the Personal Data on the basis of ‘Consent’ we ensure that we have informed you about the type of data personal data being collected and purpose of such data collection. We ensure that such personal data is being used only for the informed and specific purpose. Where you have consented to a particular processing, you have a right to withdraw the consent at any time. You can withdraw your consent by writing to us at info@apcotex.com. If you do so, your personal data will be erased, unless there is any legal requirement to retain it. In alignment with the DPDPA, the process of withdrawing consent is designed to be as easy as the process of giving consent.
